The Sussex County market

Lake rights are the defining valuation question in Sussex County, and they are not uniform.

Lake Mohawk, Highland Lakes and Culver Lake are private association communities. Membership, dock rights and beach access are separate entitlements, they carry fees, and they do not always run with the deed.

Two houses on the same street can therefore hold different rights and price differently for reasons a sales grid will not show unless someone checks the title and the association rules.

Waterfront, lake view and lake access are also three distinct things. Treating them as one adjustment is the most common defect in lake-community appraisals.

Seasonality is the second issue. Vernon’s market around Mountain Creek behaves partly as a resort market, and a sale that closed in February is evidence about February.

Then the data problem. Western townships bordering the Delaware Water Gap — Sandyston, Walpack, Montague — turn over rarely, and an honest report says how far it had to reach for support.

Agricultural land adds a further layer. Farmland assessment affects the tax bill; a preservation easement affects the market value, permanently, by removing development rights. Those are different facts and get treated separately.

Appealing a Sussex County assessment

Appeals are filed with the Sussex County Board of Taxation. The filing deadline is April 1, moving to May 1 in any municipality that implemented a revaluation or reassessment for the tax year.

The appraisal supporting the appeal needs an effective date of October 1 of the pre-tax year — not today's date — and the board applies the Chapter 123 Common Level Range, which can mean no reduction even where the property is worth less than its assessment.
